In the case of Farouk B., the Constitutional Council decided a “priority question of constitutionality” (QPC) regarding the new article L. 228-2 of the Internal Security Code (CSI) of France. The Council upheld the use of house arrest in common administrative cases, even though the measure was transposed from the 1955 law intended for states of emergency. The Council imposed only several restrictions on this expanded use of house arrest, including the availability of effective remedies for persons detained.
