Constitution et évaluation. Faut-il constitutionnaliser l’évaluation ou faut-il changer notre gouvernement ? [Par Thomas Perroud]

The aim of this post is to reflect on the constitutionalization of impact assessments (IAs) in France. The discourse on impact assessment was promoted by the Conseil d’Etat as a way to increase its control of lawmaking. That’s why the process is, in the end, a failure. If we want to improve law making in order to ground statutory reforms on evidence, we need first to reflect on the place of research inside the French administration and second to think about our form of government that is probably the reason we cannot draft more evidence-based laws and, third, wonder which institution could review IAs. The National Statistical Institute seems to be the best candidate to review IAs.
